davidtu - I bought mine in the store as well. I paid for it by credit card, and have a receipt. Expected delivery date is 11/29.

Now, I got a call this morning from Sears, a lady left a message on the machine. Nothing specific, just "calling about your drill press order". The ladytalkedrealfastcouldntevenmakeouthername. Took me 10 minutes to decipher the phone number she left. When I called back in the afternoon, I talked to someone else who checked my order, said everything was fine, still an expected delivery of 11/29. So, I guess I have to wait and see.

Note that I bought mine on Saturday, that was the day after it went on sale. I still have a hard time believing that if it really was a pricing mistake, they would let it sit for an entire day.

I "bought" it on Friday, and they will not honor the sale, I get many reasons but the all result in refusal to honor the price. It seems it maybe an area specific issue as out west it seems that I have not read of many successes.

Litigation over price mistake???

I can understand that Sears didn't handle this issue very well, especially since people were charged for the item, or a store manager rang it up for them...but now discussions about a lawsuit? For those of you that got the deal - congrats. For those that didn't...I think it is time to move on. You can vote with your dollars - never shop at Sears again if you are so inclined - or spend thousands of dollars on legal fees, pay for arbitration, and two to three years from now....let us know the result.

I agree, legal action seems over the top. I personally will only buy from them if it is real deal, that is if you can actually buy it.

actually since I had received the automated call ... I did call the merchandise pickup ... and they verified that "my" DP was in bin #1 and ready for pickup ... I told them ".. don't let anybody have that puppy I am on my way ... " and before I could get my keys together the phone rang and another "dept supervisor" called to advise me that he had overheard the call I just had with "Tammy" and in fact my order was in the process of being canceled and I could NOT come pick it up ... OH if only I had gone yesterday but life got in the way ...

Blade, man that is one big roller coaster ride. I think they owe you 2 DP's for the price of the one just for the emotional ride they put you on.
We don't answer the phone here, but listen to who is leaving a message, then pick up if we need to talk to the caller. I'd have left to go after the DP and conveniently forgot I heard them call!
Sears has created a nightmare on this. I also agree that if they had just come out and said it was a mistake and we are sorry. Here is a $XX.00 coupon toward the price of this drill press as an apology for our mistake, to those that had ordered before the price was changed on the website and ordering page, then I think things would have been different. Isn't that what Woodcraft did with their bumble on the PM2000? I've heard no ill will from that situation. It was an honest mistake, but they did something to try to make up for it. Sears can't even make a decision that sticks much less works, and can't even do it on a case by case basis, as your ordeal shows. Half of me says everyone should drop it and go on, but when I see something like this, the other half says the ones treated his way should persue it to a higher level. I guess at some point, you have to say enough is enough, and just go on. Jim.

My order cancelled

Just received a call from the local Sears tool manager who had previously reordered my drill press for the sales price. He said my order was cancelled at the corporate level and wasn't going to be shipped. He did credit my credit card for the amount. He gave me a national Sears Phone # 1-800-549-4505 which didn't do any good. Just a nothing they can do answer from them. Kind of a bad way to do business.

Yes my credit card was in fact charged an I got the statement from the credit card yesterday showing the charge ...

I am perfectly willing to spend the $78.50 to file this suit in small claims court with a full expectation that I will recover that cost in the settlement.

My attorney has directed me to several similar cases and I will be able if necessary, to use them for reference in court should it actually come to a hearing (an no I'm NOT paying for this "free legal advice" ....he's doing it pro bono because he is as amazed that sears would take this stance as I am).

Basically my point of view and the suit I will bring is that

#1 Sears.com advertised the drill press for $179.xx AND many people actually received the drill press for that price some even recently as documented on this board

#2 the local sears store made a "local management decision" to cancel my sears.com order and sell me the drill press "from the store" for $168 .. there was even a discussion between the sales clerk and the manager about the pricing AND the manager had to ring up the sale as a price override showing the discount as due to "customer satisfaction" ... at this point sears.com pricing is totally out of the picture and the local store management has entered into a contract with me for the agreed upon price of $168 + tax ... and I have the sales receipt from the store and the credit card statement to show that they sold it and I paid for it (pretty much the end of the story at that point)

#3 I contacted the local sears store on the promised delivery day and had another sears store manager actually tell me it had not arrived on the truck but that they had them in stock and he would transfer in store stock to merchandise pickup as a courtesy ... and he did that

#4 I received a call the next day telling me the sale was to be canceled as it was all a big mistake ... but I have a store receipt and have been charged ... if I had picked up the drill press the night before it would have been delivered at the agreed upon price

#5 I received an automated call from sears telling me my item was ready for pickup, I called merchandise pickup and had them verify it was physically in the bin and I could come get it ... if you are keeping count .... that is a total of 4 times "sears" has told me I could have the drill press at this low price ... once from sears.com, once from the local store manager that canceled the sears.com order and rang up the drill press at $168, once by the local store manager that said it didn't come on the truck but he would move one from stock, and finally once when I called the local store merchandise pickup to verify it really was there ... how many times do they get to screw up before they really have to sell me the darned thing?

#6 I then received a call telling me it was being canceled and I could not pick it up

#7 I contacted the "sears customer complaint department", they contacted the 2nd line manager and he contacted me to say they wouldn't honor the sale ...

so.... it is well worth the $78.50 filing fee to see how they will try to continue to weasel out of this contract and if in fact they are willing to suffer the cost THEY will incur to have a lawyer actually appear in small claims court to fight this OR if they will see the lawsuit is filed and contact me to reach a settlement - which would be fine with me, all I want is the stinkin' drill press.

By the way the suit will be for the "replacement amount" of the drill press which is clearly documented in their tools catalog (good luck finding it online now) as priced at $529 + of course the court costs.

My order canceled, too

I had order the DP on Saturday 10/12/07 at my local store. Printed the ad from sears.com for $179.99 before going into store and there was also a sale sign posted next to the DP for the same price. Sales person pulled the sign as I was ordering it.

My credit card had been billed and paid for in my last month statement. DP was schedule for delivery on 11/27/07.

Received a message today 11/3/07 from my local Sears about my order being canceled and they need my credit card number to reverse the charges.

I’m looking to file sue, now. Since I work for a county, I just need to go upstairs to talk with the County Lawyers.

I'm with you guys. If Sears had just come out immediately and said they made a mistake, that would be one thing, but they keep jerking a lot of us around, making us believe one minute that we will get our order, and then cancelling it the next. You can call the customer service line and get a different story every time you call. In my case, I was told one was in stock and to come get it. When I got to the store, I was told they had been sold out and didn't even have my order on file. What really irks me, and I assume most of you as well, it that even after they said it was a mistake, it took most of the day just to take the item down off the website. I believe that as long as we had our orders in before they took the page down, they should honor the deal.

Sears has cost themselves more in bad reputation over this than what they may have lost by selling the item at that price. I will say that it will be a very long time before I buy anything else from them. Shame too, since the holidays are coming up and the local store usually has a decent selection during that time.

This is cut and dry in most cases. You knew the deal was too good to be true and you expected there was a chance the deal would be killed. Mark it up as a lesson learned, some won and some lost...

For the record: I didn't even bother trying to get in on it since it seemed like too much of a long shot.

Life is too short, and time too valuable. FYI - you have to prove damages....emotional distress? Being right is one thing and spending time, money and energy to prove you're right is another. Just walk away - the next deal is right around the corner.

Yeah that is small claims and it still varies from state to state. But I think there may be enough costs and damages to go through the trouble to file a class action law suit. (cost in time to attempt to follow through, Gas to go to stores and then be told it isn't available, Telephone charges and other associated costs and damages)

I got the call last night that my order was canceled and that I would be refunded the purchase price......but I already picked up the drill. We'll see how this plays out.

One question about the drill handle.....I haven't opened/assembled mine yet (no time). But was in a local Sears last night looking at the floor model....there seemed to be quite a bit of play/sloppiness in the handle/arm. It could wiggle around quite a bit before the quill would engage/move down.

Is there an adjustment for this? Do you have it in your drill?
