    Am I Liable?

    Our backyard is totally enclosed with a 6' board on board fence. We have 3 cats, but they are inside cats. Our neighbor has an outside cat, and knows we have two large German Shepherds.

    Our back yard is their hunting ground and they consider anything that moves as game. If their cat is caught by our dogs and chewed up into tiny morsels, am I libel?

    I can't see that you would be liable for that. You neighbor has a responsibility to keep his animals out of your yard.

      That's what I was thinking. BTW, liable is a much better spelling. I must have been sick on the day they covered the "L's". Fortunately with your extreme insight, you knew what I meant.

        It would be libel if you were to slander the neighbor's cat.
        Sometimes the old man passed out and left the am radio on so I got to hear the oldie songs and current event kind of things

            You're only liable if you had a forseeable problem and didn't act to prevent it. You can't really post a no trespassing, or beware of dog sign that a cat could read and say, "maybe I sould not go over there."

            Plus you have taking steps to prevent anything from getting into your property by installing the fence. The same could be said with a pool. Most cities require a fence around a pool to prevent "accidental" drowing. If you have a fence up, someone could still get over the fence, get in the pool, and still drown. You wouldn't be liable because you were trying to prevent an accident from occuring.

              I suspect the cat will stay clear of the hunting grounds once it senses the nature of the dogs.

                    The only way you would be liable to get nailed is if your dogs enticed the cat to enter, by dressing up as giant mice or masquerading as brand new fabric furniture.

                        Cats usually figure it out, if the survive the first couple of trespasses. My dogs like our cats just fine, infarct sleep with them. How ever any other cat whom come in the yard is fair game. I feed and house a semi Feral Cat in my shop, the mother of two of our kittens. The was Neighborhood in fact two of them that would come into the shop to eat. One night I saw them in there, got the dogs a let them in and held the partially close for about 30 sec. then opened it. Those two cat got the message and have not been back. Momma Kitty is allowed in and they tolerate her but would chase if they had the chance. The dogs have come in the shop while she has been there, she just get a little higher up and every thing is fine. Dog defend their territory and pack against all intruders, that's their job.

                        A number of years ago a neighbors German Shepard Show dog came across the street and jumped our Siamese cat. After a brief scuffle the dog left and a very bloody nose and ripped ear, end of show career. The guy tried to sue me but ended up with a ticket for letting his unlicensed dog run loose.

                          That reminds me of the man/woman thing. He chases her until she catches him. The truth is, dogs don't fare too well with a cat with claws...unless it gets real lucky.

                            OTOH, if your dogs somehow got loose and entered their yard and killed the cats, then you might be liable for their actions. Better keep the fence in good repair.
