    What's the over/under on

    How long it takes soon-to-be-former-Durham DA Mike Nifong to get sued by the families? Or is it even legal to sue him?

    *edit* Not legal to sue him but it is legal to sue the county. So...

    How long it takes Durham County, and the accuser and Duke University to get sued by the families?

    All charges against Duke LAX players to be dropped

    I don't know if it's legal to sue him, but I know it's illegal to kill him. Better try to sue for slander.

      I doubt he will be sued but he may be disbarred as he seems to have played fast and loose with the laws of the court. I don't think the Duke boys were angels but that is not one mans(Nifong's)decision.Present the facts and let a jury decide. A cloud will follow these boys for the rest of their lives.

        IMHO, surgery to eliminate the possibility of his genes being passed on to future generations would be adequate pay-back.

          What I find disturbing about the whole case is the jumping on the bandwagon. When the case first started the whole trend was that the students were "probably" guilty. Now that the case has been dropped, the new bandwagon is how much of an injustice the whole ordeal was.

          I watched the 15 minutes of fame for all the lawyers and the students in their press conference. When the doctor gave his press conference on the cause of death and drugs in the Anna Nicole Smith death, his speech was a half hour long before getting to the facts. This is the media, and lives (the students) became the object of the frenzy.

          There was an HVAC shop next to my first shop. One day the police pulled up (several cars) and arrested one of the owners. When the dust settled I found out it was for attempted rape. What happened was, he was driving to work early that morning, and stopped at a signal light. There was a girl on the corner who tried to solicit him for sex. He refused and probably cursed her, and went on to work. She got PO'd and took down his license plate number and car description and reported her story. To make a long story short, he was arrested, put in jail, had to hire a lawyer and go through the legal hassle, not to mention the cost of proving he was innocent. What cleared him was a witness who got held up in traffic for a few moments while the girls' offer was being made and read about the incident in the paper. Also, his timeline from the time he left home to get to work, and there was no evidence in the car that a struggle ensued, and she couldn't pick him out of a picture lineup sometime later. Accusations like that are difficult to deal with and could have been a long term for him. The charges were later dropped.

            I think there should be some sort of punishment for those who make these allegations. I know that's a tricky subject, but in a case where there is ample evidence the person was lying, there should be a penalty. Look at all the costs the courts have incurred, etc. That's not even taking into account all the "activists" that chose to make all sorts of issues out of this.

            I agree, I don't think those players are angels, but a tag like "rape" sticks with a person.

              Don't know all the details of the case, just the basics. I would say filing a false police report (or what ever it's called) could be filed against them.

                That's exactly why I don't think things like this should ever reach the media until a conviction is made. No conviction? No story.

                  They say rape is underreported, because its so hard to prove.
                  Taking retaliation against the accuser, if the allegation is somehow refuted, will just increase the rates at which its underreported and embolden the rapists.
                  Take the viewpoint of a victim - first you feel bad, having been victimized, you have to come forward, subject yourself to medical tests and reliving the event over and over in testimony, and in court you will be dragged over the coals and your morals called into question and the subject of pointing fingers. On top of that, if your local DA fails to make his case due to no fault of your own, you will be subject to prosecution?

                  It's extremely hard in either case, for everyone invloved. Very traumatic.
                  Mostly he said, she said. I'm sure in many cases its totally as one side says and there's also some cases where both sides are stretching the truth.
