    Ebay Issues Continued

    OK, I bought a vacuum pump via eBay, and when it arrived the motor casing was cracked and it wouldn't start up. Since the outter box was fine, and only the inner box was damaged, it seems obvious to me that the damage occured prior to UPS picking the package up.

    I contacted the seller, and they insisted that it was UPS' fault. Although I disagree, I did what they said and started a claim with UPS.

    That was some time ago. UPS is showing the claim status as waiting for the shipper's documentation to confirm the value of the damaged item. I sent an email to see what the delay was, as it had been in that status for over a week. They said that the shipper has to inquire, as they can't inform me.

    So, as it stands, the claim has been halted in it's tracks for a week and a half, the seller isn't communicative regarding what's going on, and I won't get refunded until UPS pays them.

    It seems to me that I should get my refund now. The claim is between the seller and UPS, but me not having the item is between me and the seller- and I no longer have the item (UPS picked it up). I've never had issues with eBay before, and the last couple of transactions have been such a pain in the butt...

    Anyways, after my rant, I'm just curious as to what you all think- should I get refunded now- or only after the claim process with UPS has been completed and the shipper gets their money?

    I think if the seller were going to do 'the right thing' and refund your money now they would have done so already. Unfortunately you will probably just have to wait for the refund. How did you pay for it? Paypal or Paypal via CC? Your CC company is also a recourse - file a dispute with them. Also if you haven't left feedback yet, you might contact the seller and remind them of that.

      I paid via Paypal/ CC.... I had opened a PayPal dispute initially, before filing the UPS claim. However, the dispute was closed after 20 days automatically (can I re-open, I have no idea?). So yeah, hopefully I'm not taken for my $...

        I don't know if you can reopen the dispute. I would contact Paypal again and file the dispute. Also file a dispute with your CC company. And again, contact the seller and remind them that you haven't left feedback. That might motivate them. I would also offer to ship the item back. The seller might be thinking you are attempting fraud.

          Well, he's not going to be in business very long if that's the way he operates.
          This is akin to a store owner telling you you have to wait for th manufacturer to reimburse him before he can give you a refund for a broken item. Would you stand for that? I wouldn't.
