    The Rabbit ears are leaving

    Well I went to the Doc today and the rabbit ears come off the 15th of July and I will begin rehab with a Starwars Trooper boot on, Yea. Now I will be turning the double nickels tomorrow, Just hope I ca survive that in the meantime, Cya, Tommy

          09/06/2008 My Landlord moved a ladder I was working on that I had tied off to a tree limb with a tiedown strap. He had bumped the bottom of the ladder and disengaged the locking mechanism while I was away from his house where he has gotten a chainsaw pinched in a treelimb while intoxicated. He was intoxicated when he bumped my ladder as well. However he failed to tell me and I climbed up the ladder without inspecting it as I was doing the removal of the tree limb by myself. As I released the catch on the tiedown the ladder collapsed with my foot and ankle caught in the ladder from 22-24 ft.Shattered it into 7 pieces, Of course he denies all culpability and has refused to submit it on his homeowners ins. Claims I was an Independent contractor and I,m required to have liability ins. His pay to me was taking something off the rent. We will be in court for a while I,m sure. In the mean time He has gotten a D.U.I., I like my chances in court

            I thought maybe you were a standin in the movie "Misery". That looks like

              The left one looks rather painful, but then the right one looks like it's from a zombie... Not too much beach time while recovering I suppose

                Just looking at all that hardware hurts. Breaks like that can be very painful. But, there's a lesson to be learned by your mishap. That is to always check your rigging like it is to be used for the first time. Sometimes you can prevent a mishap by spending time figuring out how one could happen, and proceed accordingly.

                  Your sure right about that.But I,m not about to accept responsibility for a person whose irresponsible actions caused this accident. Being drunk at 9:30 in the morning to me shows he has a drinking problem. That might go away if he can,t afford it anymore and I intend to do just that. In 55 yrs of being on this planet I have never taken a fall from a ladder and I have been up and down them several thousand time without incident. But whats worse is I have known this guy for 16 yrs and he could not even drive to the hospital to see how I was after the incident. And now has the balls to demand rent payment or face eviction. I,m self-employed and did not have any insurance like 49 million other americans, but what irks me is the fact I was trying to do him a favor, A tree service would have charged him at least 4-500 dollars and now I have, after 3 surgeries about $80,000 worth of medicals bills because he doesnt want his ins. to go up.It will be yrs before I see a dime and now will be permanently deformed. No flag football, soccer, softball. I used to run a mile every morning before work and have always had an active lifestyle,but his ins. co will fight me tooth and nail for every penny I,ll bet and my attorney wants a third of whatever we get. He says to probabaly only expect them to settle for around 150k and pay the meds, bullcrap I want 500k and a lifetime of med coverage because my Doc says this will be a debilitating injury for life and to expect severe arthritus forever in that joint much less walking with a limp from now on. I know I,m rambling but people have to be held accountable for their actions. I can,t understand why he won,t submit it to his homeowners policy? But the lesson has been learned, measure twice cut once.
