    Mortgage Co Headache

About a year ago I got an intent to forclose notice from my mortgage co, it was addressed to the Estate of Dick Peterson. This scared the crap out of me so I called them. It seems like they received a letter from a lawyer saying that I had passed on. Well it took numerous phone calls and signing a form that I was still living in the house.
    All has been well since.
Today I got a call from the escrow company handling the sale of my house. The mortgage company wouldn't send them a payoff amount because I was dead.
I played phone tag for an hour untill I was able to talk to someone that wasn't an idiot. He looked through my account and verified that I was alive and that the lawyer that reported my death last year had never supplied a social security number or a copy of the death certificate. He appologized and said it was thier fault from the start for accepting the death information without proof.

He didn't offer to reimburse me for the Scotch that it took to calm my nerves down though.

Yikes! Glad you got that figured out. Houses are usually our biggest assets, and when things get messed up it can be a very bad day in Blackrock.

I'll tip one for you later!

I am shocked and outraged that a mortgage company that would not let you within sniffing distance of their money without triplicates of forms and umpteen copies of various documents and supporting documents and witnesess and countless number of signatures would even entertain anybody calling them with news of your death. Did they say who it was? How did they accept his word?

I'd say you have a full justification for a lawsuit - if nothing else it'd force them to come out with details, and reimburse you for pain and suffering.

          Remember, this could recur...
It is the mark of an educated mind to be able to entertain a thought without accepting it.

How could they justify foreclosure if payments were being received? Even if you are dead, and your estate is making payments, I would think they couldn't have touched your house. A cloud on the title is another matter, however, and I would make sure that there is none there (although if the sale closes, you have nothing to worry about, I guess).

I am glad things got worked out for you Dick. Years ago a friend of mine received a foreclosure notice on some land he bought 6 years earlier. They said he was 42 months behind in payments. He had to prove he made the payments. He had sent a money order each month and had to produce the stubs. He had misplaced or thrown away 6 or 7 of them and he had to make those payments again to keep his land.

That would really, really upset me. They said he was 42 months late, but he could prove they were wrong on 85% of them, yet they wouldn't take his word for it for the remaining 15%??? I'm a good natured fellow, but I believe I would get pretty irate with the person who had the gall to ask me to fork over the remaining money.

Thankfully, rumors of your death were greatly exaggerated.

                    mortgage co.????

Sounds as if someone at that mortgage company has made too many
dives off the deep end and wound up making a bunch of head long plunges
into the rocks in the shallow water. That type thing or worse seems to be happening with the mortgage companies that I have to work with thru my real estate companies all the time. eezlock

He was very upset but they had the upper hand. The stubs he couldn't find were up to 2 years apart. His argument with them was if he had missed a payment they would have caught it then. To this day he keeps receipts for everything.
